GENERAL CONDITIONS of RESERVATION and RENTAL
Article 1 – Purpose: These provisions are intended for the exclusive use of booking stays in guest rooms in the guest house La Maréchalerie, located 6 rue des Rosiers, Le Sentier, 37110 MONTHODON.
The owner, Danny NIEDBALSKI, will do everything possible to give you a warm welcome and make your stay and discovery of the region easier.
Article 2 – General provisions: The tenant may under no circumstances claim any right to remain in the premises at the expiration of the rental period initially provided for in the various letters and/or emails, unless agreed by the owner.
The owner undertakes not to disclose to any third party information of any nature whatsoever, on any medium whatsoever, that the tenant may have been required to give him during the execution of this contract. These latter provisions are, however, not applicable to requests for information made by administrations and/or the Courts.
In accordance with the Data Protection Act of January 6, 1978, you have the right to access and rectify data concerning you.
These general conditions are subject to change at any time without notice.
Article 3 – Conclusion of the contract: The reservation becomes effective once the customer has sent the owner a deposit of 30% of the total price of the stay with a minimum of one night per room retained. It is the tenant’s responsibility to keep a copy of the confirmation letter or email, stipulating receipt of this deposit.
Payment of a deposit or entry into the premises implies acceptance of these general conditions of sale.
You can pay these deposits in 3 ways:
– either by bank check (bank domiciled in France, check payable to La Maréchalerie)
– or by bank transfer. We will provide you with details upon request
– or by Paypal (email to use: info@lamarechalerie.fr)
Our prices are inclusive of all charges (including tourist tax).
The balance is due on the day of departure.
Article 4 – Cancellation by the customer: Any cancellation must be notified by registered letter addressed to the owner.
1a) Cancellation before the start of the stay: if the cancellation occurs more than 30 days before the start of the stay, the amount of the deposit remains with the owner.
If the cancellation occurs less than 30 days before the start of the stay, the amount of the deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.
1b) If the customer does not show up before 7 p.m. on the scheduled start day of the stay, this contract becomes void and the owner can dispose of his guest rooms. The amount of the deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.
1c) In the event of a shortened stay, the price corresponding to the cost of the accommodation initially planned must be paid in full to the owner.
Article 5 – Cancellation by the owner: When before the start of the stay, the owner cancels this stay, he must inform the customer by any means. The customer will be reimbursed for the amounts paid within 8 days.
If the cancellation occurs less than 10 days before the start of your stay, La Maréchalerie undertakes to offer you equivalent accommodation nearby, at a similar price.
Article 6 – Arrival and departure time: The customer must arrive on the specified day. Arrivals are between 5 p.m. and 7 p.m., departures before 10:30 a.m. In the event of a late or delayed arrival, the customer must notify the owner.
Article 7 – Use of the premises: The customer must respect the peaceful nature of the premises and use them in accordance with their intended purpose. The common areas (dining room, kitchen area, garden, barbecue area, etc.) are available from 8:30 a.m. but must be vacated no later than 10:30 p.m., clean and tidy.
The customer agrees to return the rooms in perfect condition at the end of the stay, to declare and assume financial responsibility for any possible damage for which he may be responsible on the property.
Article 8 – Capacity:
The contract is established for a specific number of people. If the number of customers exceeds this number, the owner is able to refuse the additional customers. This refusal can in no case be considered as a modification or termination of the contract at the initiative of the owner, so that in the event of the departure of a number of customers greater than those refused, no refund can be considered.
Article 9: Animals:
Our animal friends will not be accepted (even small ones), except guide dogs for the blind.
In the event of non-compliance with this clause by the client, the owner may refuse the animals.
This refusal cannot be considered in any case as a modification or termination of the contract at the initiative of the owner, so that in the event of the client’s departure, no refund can be considered.
Article 10: Disputes:
Any claim relating to the inventory must be submitted to the owner within three days of the start date of the stay.
Any other claim relating to a stay must be sent by letter, as soon as possible, to the owner, who alone is competent to issue a proposal in favor of an amicable agreement.
These provisions do not prejudge any legal action brought by the client or the owner. However, in the event of a dispute, the court of the owner’s domicile will have sole jurisdiction.
This contract and its consequences are subject to French law.
