GENERAL CONDITIONS of BOOKING and RENTING
Article 1. Object: These arrangements are destined to the exclusive use of the booking of stays in rooms of hosts and studios in the establishment The Maréchalerie, situated 6 Rue des Rosiers, The Trail, 37110 MONTHODON. The owners, Patricia and Danny Niedbalskis, will make all their possible to reserve for you a cordial welcome and to facilitate you the stay and the discovery of the region.
Article 2 - general Arrangements: The tenant won't be able to take advantage in any circumstance of an any right to the maintenance in the places to the expiration of the period of renting initially foreseen in the various mail and/or courriels, except agreement of the owner.
The owner commits to not to reveal to any third the information of some nature that it is, on some support that it is, that the tenant will have been brought to give him on the occasion of the execution of the present contract. These last arrangements are not however not applicable being about the demands of information that would be formulated by the administrations and/or the Courts.
In accordance with the computer law and liberty of January 6, 1978, you benefit from a right of access and rectification to the data you concerning.
The present general conditions are at all times modifiable without notice.
Article 3 - Conclusion of the contract: The booking becomes efficient from the moment the customer will have made to arrive to the owner a deposit of 30% of the total amount of the price of the stay with a minimum of one night by retained room. He/it belongs to the tenant to keep a copy of the mail or courriel of confirmation, stipulating the good receipt of this deposit.
The remittance of a deposit or the entry in the places (room or studio) imply the acceptance of the present general conditions of sale.
You can adjust these deposits of 3 ways :
- either by banking check (resident bank in France, check to the order of The Maréchalerie)
- either by bank transfer. We will provide you the details on demand
Our prices get along all included loads (including tax of stay).
The balance is to adjust the day of the arrival.
Article 4 - Annulment by the customer: All annulment must be notified by registered letter referred to the owner.
a) Annulment before the beginning of the stay: if the annulment intervenes more than 30 days before the beginning of the stay, the amount of the deposit remained acquired to the owner.
If the annulment intervenes less than 30 days before the beginning of the stay, the amount of the deposit remained acquired to the owner who reserves the right to ask for the balance of the price of the lodging.
b) If the customer doesn't appear before 19 hours the day foreseen of stay beginning, the present contract becomes hopeless and the owner can have his/her/its rooms of hosts or studios. The amount of the deposit remains acquired to the owner who reserves the right to ask for the balance of the price of the lodging.
c) In case of shortened stay, the corresponding price to the cost of the lodging initially foreseen should fully be paid to the owner.
Article 5 - Annulment by the owner: When before the beginning of the stay, the owner annuls this stay, he must inform the customer throughout middle. The customer will be repaid of the is poured under 8 days.
If the annulment intervenes less than 10 days before the beginning of your stay, The Maréchalerie commits to propose you an equivalent lodging close by, of a similar price.
Article 6 - Hour of arrival and departure: The customer must present himself/itself the specified day. The arrivals make themselves between 17 h and 19 h, the departures before 10 h 30. In case of belated or deferred arrival, the customer must warn the owner.
Article 7 - Use of the places: The customer should respect the restful character of the places and should make an use of it in conformity with their destination. The common spaces (dining room, corner cooks, garden, zone barbecue etc.) are at service since 8h30 but must be freed at the latest to 22h30, clean and orderly.
The customer commits to return the rooms in perfects state at the end of the stay, to declare and to assume all possible deterioration of which he could be responsible on the property financially.
Article 8. Capacity :
The contract is established for a precise number of people. If the number of customers passes this number, the owner is able to refuse the supplementary customers. This refusal cannot be considered on no account like a modification or a rupture of the contract on the initiative of the owner, so that in case of departure of a number of customers superior to those refused, no repayment can be considered.
Article 9: Animals :
Our friends the animals won't be accepted (even small), except the dogs guides of blinds.
In case of non respect of this clause by the customer, the owner can refuse the animals.
This refusal cannot be on no account considered like a modification or a rupture of the contract on the initiative of the owner, so that in case of departure of the customer, no repayment can be considered.
Article 10: Litigations :
All relative complaint to the state of the places must be submitted to the owner in the three days following the date of the beginning of the stay.
All other relative complaint to a stay must be addressed by letter, as soon as possible to the owner, only competent to emit a proposition in favor of an amicable agreement.
These arrangements don't prejudge possible judicial actions instituted by the customer or the owner. However, in case of litigation, the court of the owner's domicile will be alone competent.
The present contract and his/her/its continuations are submitted to the French law.
